We will request or receive a copy of the executed contract. Instructions on where that is to be sent to will be given to you over the phone or via email.
Check the property title. This will reveal the actual property details and any encumbrances on title.
We will call, email you with our first letters and send reminders of any important dates, including stamp duty and any other important forms to prepare transfer documents.
Notify the seller or buyers solicitor that Smith Law Group are acting for you!
Notify the agent that we (Smith Law Group) have received the contract.
If you're purchasing a house PLEASE take out building and public liability insurance or if the property is a unit, take out contents and public liability insurance.
Have you considered the condition of the dwelling? If so, you may need to arrange building and pest inspections.
Obtain finance approval PRIOR to the due date, or PLEASE notify Smith Law Group if we need to negotiate an extension of the settlement date.
Return any forms completed given to you by Smith Law Group so we can prepare for your transaction.
Do you have any other properties being re-financed? If so please notify Smith Law Group.
Once your contract goes unconditional, most of the work is left up to our conveyancing solicitors & property lawyers in Cairns. Please see below as to what we will be doing to ensure everything goes smoothly.
STEP 1 : Ensure that the financier is ready for settlement
STEP 2 : Prepare settlement figures
STEP 3 : Make sure you/client have completed and returned the stamp duty declaration forms
STEP 4 : Book settlement with your financier and seller’s Solicitor
STEP 5 : Send a copy of the settlement statement to you/client this will set out the total amount required for your settlement
STEP 6 : Ensure that either the bank or Smith Law Group has received the balance of settlement
Arrange mortgage and or transfer documents to be signed and returned.
